AI is giving compliance teams more visibility than ever, but greater coverage creates new questions around accountability, explainability and human oversight.
In this episode, Joe Jordan speaks with Jeremy Dela Cruz, Senior Manager for Global Marketing Compliance at NinjaTrader, about the shift from sampling to surveillance, the emerging risk of “AI compliance slop” and what firms should expect from AI compliance technology.
Jeremy also explains how NinjaTrader uses Adclear for pre-publication review, helping automate lower-complexity checks while keeping human judgment focused on the decisions that need it most.
From sampling to surveillance
Historically, a compliance team reviewing an influencer might watch a handful of videos and treat them as representative of the wider channel.
AI changes that. Jeremy explains how teams can now scan entire YouTube channels in a single session, across multiple creators and markets.
The implication goes beyond efficiency. As fuller visibility becomes possible, the standard of oversight may change with it.
The risk of “AI compliance slop”
Jeremy describes an emerging risk he calls “AI compliance slop”: accepting AI-generated risk assessments, reviews or reporting without properly interrogating the information behind them.
AI can dramatically expand compliance coverage, but accountability still sits with the firm.
As Jeremy puts it, regulators supervise firms and individuals. They do not supervise software.
Explainability comes first
For Jeremy, one of the most important considerations when selecting an AI compliance vendor is explainability.
Firms need to be able to show what was reviewed, what was flagged, why it was flagged and how the final decision was reached.
That audit trail needs to be reproducible when a regulator asks for it.
How NinjaTrader uses Adclear
NinjaTrader uses Adclear for pre-publication marketing compliance review.
Adclear helps identify issues including missing disclosures, potentially misleading claims and other lower-complexity checks, allowing Jeremy's team to concentrate on the decisions that require deeper compliance judgment.
US vs European approaches to compliance
Joe and Jeremy also discuss the differences between US rules-based regulation and more principles-based approaches in Europe, and how global firms can build processes that work across multiple products, markets and regulatory regimes.
